Do You Need Permission to Remove a Tree in Hertfordshire?
One of the most common questions we get from homeowners is: "Do I need permission to cut down a tree in my garden?" The answer depends on a few factors, and getting it wrong can result in fines of up to £20,000.
When You Don't Need Permission
In most cases, you're free to carry out work on trees in your own garden without any council involvement. This includes:
- **Pruning and trimming** trees that don't have a TPO
- Removing dead trees (even if they have a TPO, dead trees can usually be removed — but you should notify the council first)
- Trees under 75mm diameter at chest height (about the thickness of a tennis ball) can generally be removed without notification, even in conservation areas
- Fruit trees being managed for fruit production
When You Do Need Permission
Tree Preservation Orders (TPOs)
A TPO is a legal order made by your local council to protect specific trees or groups of trees. If a tree has a TPO, you need written consent from the council before carrying out any work, including pruning. The penalties for unauthorised work on a TPO tree can be severe — up to £20,000 in a magistrates' court, or unlimited in a crown court.
Conservation Areas
If your property is in a conservation area, you must give 6 weeks' written notice to the council before carrying out work on any tree with a trunk diameter over 75mm (measured at 1.5m above ground). The council then has 6 weeks to respond — they can make a TPO to protect the tree, or allow the work to proceed.
